Preparing your rental agreement
1. Agree the basics
Monthly rent, security deposit (usually 3–10 months in Chennai), maintenance charges, due date and lock-in period.
2. Collect documents
ID and address proof of owner and tenant (Aadhaar/PAN), property ownership proof, and passport photos.
3. Draft the clauses
Parties, property address, term (typically 11 months), rent and escalation (5–10% yearly), deposit refund terms, notice period, permitted use, repairs, and inventory of fittings.
4. Stamp paper
Print on non-judicial stamp paper of the value required under Tamil Nadu rules, or use e-stamping.
5. Register the agreement
Under the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017, tenancies must be registered with the Rent Authority. Submit within the prescribed time.
6. Sign with witnesses
Both parties sign every page in front of two witnesses. Keep a copy each.
7. Police verification
Submit tenant details to the local police station — owners in Chennai are expected to do this.
