Tamil Nadu rent increase rules
What a landlord in Chennai must do before raising the rent, based on the Tamil Nadu tenancy Act and the state's Rent Portal. This guide does not set or suggest any rent figure.
1. Your agreement comes first
Section 9(1) of the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 (Act 42 of 2017) says rent is revised as set out in the tenancy agreement. Read the rent clause before you sign: look for the amount, the percentage or the method of any increase, and when it applies.
2. Three months' written notice
Section 9(2) says that, unless the agreement provides otherwise, the landlord must give written notice three months before the revised rent becomes due. Ask for the notice in writing and keep it.
3. Silence can mean acceptance
Under Section 9(3), a tenant who is given notice of an increase and does not give the landlord notice of termination is treated as having accepted the increase proposed. If you disagree, respond in writing during the notice period instead of waiting.
4. Fixed-term tenancies
Section 9(4) says that when a home is let for a fixed term, rent may not be increased during that term unless the amount of increase, or the method of working it out, is expressly written in the agreement. An increase that is not in the agreement should not apply until the term ends.
5. Increase after improvements
Under Section 9(6), if the landlord pays for an improvement, addition or structural alteration with the tenant's agreement, the rent may rise by an amount agreed before the work starts. It takes effect one month after the work is complete. Repairs the landlord must do under Section 15 do not count.
6. Is there a percentage cap?
In the sections we read, the Act sets no fixed percentage limit on an increase. It leaves the figure to the agreement and to the Rent Authority if the parties cannot agree. We have not found an official figure, so we do not quote one.
7. If you cannot agree
Under Section 10, as amended in 2018, the Rent Authority can fix or revise the rent on an application by the landlord or the tenant, and fix the date the revised rent is payable, in accordance with the tenancy agreement. See the official Rent Portal for how to apply, and speak to a lawyer about your own case.
8. The 2018 amendment
The 2018 amendment removed Section 9 sub-sections (5), (7) and (8). Older websites that still describe those sub-sections may be out of date.
