Tamil Nadu rent deposit rules
How the security deposit works for a rented home in Chennai, based on the Tamil Nadu tenancy Act and the state's Rent Portal. Where the official pages do not give a figure or a procedure, we say so.
1. Which law covers your deposit
In Tamil Nadu urban areas, security deposits are covered by Section 11 of the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 (Act 42 of 2017), as amended in 2018. The state's own Rent Portal FAQ says the Act covers both residential and commercial tenancies.
2. The three-month limit
Section 11(1) says it is unlawful to charge a security deposit of more than three times the monthly rent. The sentence opens with the words “Save an agreement to the contrary”, so how the limit applies when an agreement says something different is a legal question. Ask a lawyer if your landlord asks for more. Example only: at a monthly rent of ₹10,000, three times the rent is ₹30,000.
3. Write the deposit into the agreement
The Act requires tenancies to be in writing and registered with the Rent Authority. State the exact deposit, how it will be paid and what it can be set against. Keep a signed receipt for the amount you pay.
4. Deductions the Act mentions
Section 11(2) allows the landlord to refund the deposit after making due deduction of any liability of the tenant. Section 15(3) adds that if a tenant refuses to carry out scheduled or agreed repairs, the landlord may get them done and deduct the cost from the security deposit. Ask the landlord for a written list of any deduction.
5. When the refund is due
Section 11(2) was amended in 2018. It now says the deposit is to be refunded to the tenant at the time the landlord takes over possession of the vacant premises, after due deductions. Hand over the keys against a written acknowledgement and agree the refund in writing on that day.
6. Advance rent when a landlord takes possession
Section 24 deals with a landlord who recovers possession through the Rent Court under the Act. Before recovery, the landlord must refund any rent or other payment received in advance, after deducting rent and charges due. If a refund is not made, the landlord can be made to pay interest at the rate prescribed.
7. If the deposit is not returned
Ask in writing first and keep a copy. The Act sets up the Rent Authority, Rent Court and Rent Tribunal for tenancy disputes. See the official Rent Portal for how to apply, and speak to a lawyer about your own case.
